This User Agreement (hereinafter referred to as the Agreement) governs the relationship between represantantives of the Website or mobile app (hereinafter Administration) on the one hand and the users of the Website or mobile app on the other.
The Website and mobile app are corporate and not a mass media web resource.
By using the Website, you agree to the terms of this agreement.
If you do not agree to the terms of this agreement, please leave the Website immediately.
By accepting the Agreement, you also agree to our Privacy Policy.
General provisions of the User Agreement
In this document and the resulting or related relations between the Parties, the following terms and definitions apply:
a) User - a capable natural person who has acceded to this Agreement in his own interest or acting on behalf and in the interests of the legal entity they represent.
b) Website - website and mobile app hosted in the defactory.app domain and its subdomains.
c) Administration - represantantives of the Website or mobile app.
d) Service - a set of services provided to the User using the Website.
e) Agreement - this agreement with all additions and changes.
Modification of this Agreement
The Agreement (including any of its parts) may be changed by the Administration without any special notice. The new version of the Agreement comes into force from the moment it is posted on the Website or brought to the attention of the User in another convenient form, unless otherwise provided by the new version of the Agreement.
Spread of information
The information provided on the Website is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation. Accordingly, persons who choose to access the Website from other locations do so on their own initiative and are solely responsible for compliance with local laws.
Site user age criteria

You agree that when using the Website and the Service, you are at least 18 years of age, or you are accessing the Service under the supervision of a parent or guardian, and you are legally able to enter into a contract. - Remove or alter any trademark, logo, copyright notice or other similar notices on the Website;
- Distribute, sell, sublicense, use the software that is part of the Website, or in any other way transfer rights to such software.
You agree not to employ software or to carry out actions aimed at disrupting the normal functioning of the Website.
You have the right to use the Website information for personal non-commercial purposes.

Administration hereby expressly excludes any liability for any direct, indirect loss or damage suffered by any user in connection with the Website or in connection with the use, inability to use or results of using the Website, any websites linked to it, and any materials posted on the Website, including lost profits or contracts; loss of expected savings, income or revenue; data loss or business reputation.

The Website may contain links to other websites that are not owned or controlled by Administration. Please note that we are not responsible for the privacy practices of such websites or third parties. Dispute Resolution
In the event of any disputes or disagreements related to the execution of this Agreement, the User and the Administration will make every effort to resolve them through negotiations between them. In the event that disputes are not resolved through negotiations, disputes shall be resolved in the manner prescribed by international law.
The claim procedure for pre-trial settlement of disputes from the Agreement is mandatory.
Compensation
The User is responsible for all expenses (including compensation for losses, harm, fines, legal and other costs and expenses) of the Administration in case of any claims by third parties, including (but not exclusively) claims related to the protection of intellectual rights of third parties , and for any obligations incurred by Administration in connection with the requirements of third parties related to the violation by the User of the terms of the Agreement. The User undertakes to take all necessary and possible measures aimed at exclusion of Administration from the number of defendants in such claims.
The Administration is not liable to the User and does not reimburse the User for any losses incurred or that may arise from the User due to delays, interruptions in the operation of the Website, the impossibility of full use of the Website.
Other provisions
The Administration reserve the right to investigate complaints or reports of violations of this Agreement and take any action they deem appropriate, including, but not limited to, reporting any suspected illegal activity to law enforcement officials, regulators, or other third parties and disclosing any information necessary or relevant to such persons or entities regarding user profiles, email addresses, usage history, hosted content, IP addresses and traffic information.
The Administration reserve the right to pursue all remedies available at law and in equity for a breach of this Agreement, including, but not limited to, the right to block access from a specific internet address to the Website.
The Administration failure to enforce or enforce strict performance of any provision of this Agreement shall not be construed as a waiver of any provision or right.
The Administration may assign its rights and obligations under this Agreement to any party at any time without notice. If any of these terms is held to be invalid or for any reason unenforceable, that term will be deemed severable and will not affect the validity or enforceability of any remaining term. Any rights not expressly granted here are reserved.
